1. Acceptance of these terms
By accessing or using MitiVision (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. What MitiVision is — and is not
MitiVision is an informational research tool that aggregates publicly available records about mitigation and conservation credits — bank locations, service areas, credit availability and, where public records support it, transaction pricing.
The Service is not legal, regulatory, financial, environmental or professional advice, and is not a substitute for the judgment of a qualified consultant, an attorney, or the U.S. Army Corps of Engineers. Credit eligibility and pricing must be confirmed directly with bank sponsors and the relevant regulators.
3. Accuracy and no warranty
The data is provided “as is.” We mirror figures from primary public-record sources and label each with its provenance and as-of date, but the data may be incomplete, out of date, or contain errors — RIBITS inventory in particular lags real availability, and a balance shown here can be sold before you act on it.
We make no warranty, express or implied, as to the accuracy, completeness or fitness for a particular purpose of any information on the Service. You rely on it at your own risk.
4. Permitted use
You may use the Service for lawful research and due-diligence purposes. You may not: (a) use automated means to scrape or bulk-download the Service beyond ordinary use; (b) resell or redistribute the data as a competing product; (c) misrepresent the source of the data; or (d) use the Service to violate any law or third-party right.
5. Intellectual property
The underlying facts — quantities, dates, locations, prices — are drawn from public records and are not owned by us. The Service's compilation, presentation, software, design and brand are owned by MitiVision and protected by applicable law.
6. Third-party data and links
The Service reads from and links to third-party sources, including USACE RIBITS, the EPA map service and the USGS Watershed Boundary Dataset. We are not responsible for the content, accuracy or availability of any third-party source, and an outage at one of them can leave part of this site blank.
7. Limitation of liability
To the fullest extent permitted by law, MitiVision and its operators will not be liable for any indirect, incidental, consequential or special damages, or for any decision made or action taken in reliance on the Service.
8. Affiliation
MitiVision is independent. It is not affiliated with, endorsed by, or connected to the U.S. Army Corps of Engineers, the Environmental Protection Agency, or any mitigation bank operator or in-lieu fee sponsor. For the official record of any bank, see RIBITS.
9. Changes to these terms
We may update these terms from time to time. Material changes will be reflected by the “last updated” date above. Continued use after a change constitutes acceptance.
