The U.S. Army Corps of Engineers, Omaha District, (Corps) is evaluating a site plan submitted by the North Dakota Department of Transportation (NDDOT) for the Sand Creek Stream Mitigation Bank Site (Site). The purpose of this public notice is to solicit comments on the plan from the public; Indian Tribes; Federal, state, and local agencies/officials; and other interested parties. Participation is encouraged to assist the Corps in making a reasonable decision to accept, modify or reject the plan. The U.S. Army Corps of Engineers, Omaha District, (Corps) is evaluating an Umbrella Instrument Addendum submitted by the North Dakota Department of Transportation (NDDOT) to allow for the development of stream mitigation banking credits to offset future impacts to stream resources that occur as a result of road construction activities. The Corps approved NDDOT Umbrella Mitigation Bank Program Instrument on June 14, 2013. It was established in accordance with the implementing regulations of the Compensatory Mitigation for Losses of Aquatic Resources Final Rule found at 33 CFR 332, which was published in the Federal Register on April 10, 2008. The Instrument is used to satisfy NDDOT's compensatory mitigation requirements for Department of the Army permits issued under Section 404 of the Clean Water Act (33 USC 1344) and wetland impacts recommended to be mitigated in Executive Order 11990.

Credit balances count only banks that can sell today — sold-out, suspended, terminated, withdrawn, closed-out and not-yet-approved banks are left out. Credit classes offset different resources and are never added together. Totals across many banks are rounded to whole credits — a single bank’s own balance never is. Approval timelines come from the USACE permit-processing record (ORM). We calculate the median from every bank’s milestone dates in the division. Full clock means from the first public notice of the prospectus to the final decision — it includes the applicant’s own time. Regulator clock means from the complete draft instrument being received to that same final decision — the part the Corps controls.
